Terms of Service

Think Deep is a product of Nexceed, LLC.

These Terms govern your use of the Think Deep mobile application. By downloading, installing, purchasing through, or using Think Deep, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.

1. Eligibility

You must be at least 13 years old to use Think Deep. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you.

2. General Information; Not Medical Advice

Think Deep provides general motivational, educational, and self-reflection content for personal growth. It is not a medical device or healthcare service and does not provide medical or mental health advice, diagnosis, treatment, therapy, counseling, monitoring, or crisis services. The app does not establish a clinician-patient or other professional relationship.

Do not use Think Deep to make decisions about medication, treatment, diagnosis, safety, or whether to seek professional care. Do not disregard or delay professional advice because of app content. If you may harm yourself or someone else, feel unsafe, or face an emergency, stop using the app and contact local emergency services or a qualified crisis service immediately.

3. Your Responsibility

Reflection prompts may not fit every person or situation. You are responsible for deciding whether and how to use them. Stop using any prompt that feels unsafe, distressing, or inappropriate for your circumstances, and seek qualified help when needed. XP, levels, streaks, ratings, and personalization are engagement features, not measures of health, risk, progress, or wellbeing.

4. Premium Subscriptions

Premium purchases are processed by the Apple App Store or Google Play and managed with RevenueCat. Available plans, prices, billing periods, trial terms, and taxes are displayed before purchase. Subscriptions renew automatically unless canceled through your app-store account before the next renewal. Deleting Think Deep does not cancel a subscription. Refunds, billing disputes, cancellations, and renewals are governed by the applicable app store's terms and applicable law.

5. License and Acceptable Use

Nexceed, LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Think Deep for lawful, noncommercial purposes, subject to app-store rules. You may not copy or distribute substantial portions of the app or card library, sell or sublicense access, reverse engineer the app except where law permits, bypass Premium controls, disrupt the app, introduce malicious code, or use Think Deep to violate another person's rights or applicable law.

6. Ownership and User-Initiated Sharing

Think Deep, its software, design, branding, and curated content are owned by or licensed to Nexceed, LLC and protected by intellectual-property laws. The app may let you share selected card text or an app link through your device's share sheet. You are responsible for where you send shared content and must not remove ownership notices or present the content as your own.

7. Third-Party Services

App stores, RevenueCat, device operating systems, email providers, and services you choose from the share sheet operate under their own terms and privacy policies. Nexceed, LLC does not control those services and is not responsible for their availability, security, or conduct.

8. No Warranties

To the fullest extent permitted by law, Think Deep and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement. We do not promise a particular personal, emotional, health, relationship, or professional outcome.

9. Limitation of Liability

To the fullest extent permitted by law, Nexceed, LLC and its owners, officers, employees, contractors, licensors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities, arising from Think Deep or these Terms. Where liability cannot be excluded, our total liability will not exceed the greater of the amount you paid Nexceed, LLC through Think Deep during the 12 months before the claim or US $100. These limits do not exclude liability that applicable law does not allow us to limit.

10. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Nexceed, LLC and its owners, officers, employees, contractors, licensors, and affiliates from claims, losses, liabilities, and reasonable expenses arising from your unlawful or unauthorized use of Think Deep, your shared content, or your violation of these Terms or another person's rights.

11. Suspension, Changes, and Termination

We may change, suspend, or discontinue features and may restrict access when reasonably necessary to protect the app, users, or our rights, comply with law, or address violations of these Terms. You may stop using Think Deep at any time. Sections that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms. We will change the Effective Date and provide any notice required by law. Continuing to use Think Deep after updated Terms take effect means you accept them; if you do not agree, stop using the app.

13. Governing Law and General Terms

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Except where applicable law requires otherwise, disputes must be brought in the state or federal courts located in Travis County, Texas. If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and Nexceed, LLC concerning Think Deep.

These Terms do not limit any non-waivable consumer rights you have under applicable law.
