By downloading, installing, or using ATX Alerts, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

1. General Information Only

ATX Alerts provides information gathered from publicly available sources. The app does not generate or verify emergency data and should not be considered accurate, complete, or real-time. Users must seek official sources for emergency instructions.

2. No Warranties

The app and all content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose. Nexceed, LLC does not guarantee uninterrupted service or error-free operation.

3. Limitation of Liability

To the maximum extent permitted by law, Nexceed, LLC and its officers, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use or inability to use ATX Alerts, even if advised of the possibility of such damages.

4. Indemnification

You agree to indemnify, defend, and hold harmless Nexceed, LLC from any claims, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the app, your violation of these Terms, or your reliance on the content provided.

5. Termination

Nexceed, LLC reserves the right to suspend or terminate access to the app at any time, without notice, for any reason.

6. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
