Terms of Service

By downloading, installing, or using ATX Alerts, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

1. Informational Service Only

ATX Alerts organizes incident information published by public agencies. It is not an emergency service, public-safety agency, dispatch system, or replacement for official instructions. Do not use the app to report an emergency or rely on it to protect life or property. Call 911 in an emergency and follow directions from public authorities.

2. Public Information and Alert Areas

Public agencies control when and how incident information is published. Alerts may be delayed, incomplete, inaccurate, duplicated, changed, removed, or unavailable. Neighborhood boundaries and road-name matching are approximate and may include an unrelated incident or miss a relevant one. Fire and traffic sources may report the same incident as separate alerts.

3. Notifications

An account is required for personalized notifications. Notifications are optional, and delivery is not guaranteed. Device settings, internet access, delays in public reports, and other factors may delay or prevent a notification. Receiving no alert does not mean an area or road is safe.

4. Limited License and Acceptable Use

Nexceed, LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to use ATX Alerts for lawful purposes. You may not disrupt the service, bypass security or usage limits, misuse automated requests, reverse engineer the service except where law permits, or use the app to violate another person’s rights.

5. Ownership and Third-Party Content

ATX Alerts software, design, and branding belong to Nexceed, LLC or its licensors. Public-agency data and third-party maps, links, and services remain subject to their respective owners’ terms. We do not control or endorse third-party content merely by displaying or linking to it.

6. Service Changes and Availability

The free plan includes notifications for one neighborhood. Premium adds multiple neighborhoods and road or highway monitoring through the Apple App Store or Google Play. Premium renews monthly unless canceled through your store subscription settings. The current price, billing period, renewal terms, and cancellation details are shown before purchase. Deleting your ATX Alerts account does not automatically cancel a store subscription. We may change, suspend, limit, or discontinue alert sources, coverage, roads, notification features, or eligibility, and will provide notice when required.

7. No Warranties

To the maximum extent permitted by law, ATX Alerts and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, availability, reliability, merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Nexceed, LLC and its officers, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from reliance on an alert, a missed or delayed alert, use of the app, or inability to use the app.

9. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Nexceed, LLC and its officers, employees, contractors, and affiliates from claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of the app or violation of these Terms.

10. Suspension and Termination

We may suspend or terminate access when reasonably necessary to protect the service, users, third parties, or comply with law. Provisions that by their nature should survive termination will remain in effect.

11. Governing Law and Severability

These Terms are governed by Texas law, without regard to conflict-of-law principles. Disputes will be resolved in state or federal courts located in Travis County, Texas, unless applicable law requires otherwise. If any provision is unenforceable, the remaining provisions remain in effect.
